TERMS AND CONDITIONS

Introduction

These Terms and Conditions constitute a legally binding agreement between you (the "Client") and Tutorian Tuition, operated by Katherine a sole trader in the United Kingdom.

By accessing or using our tutoring services, you agree to comply with and be bound by these Terms and Conditions, along with our Privacy Policy. If you do not agree with any part of these terms, you must not use the service.

You must be at least 18 years old to enter into this agreement. If you are under 18, a parent or legal guardian must provide consent and engage on your behalf.

These Terms are governed by and construed in accordance with the laws of England and Wales.

About Tutorian Tuition

Tutorian Tuition is a private tutoring service owned and operated by Katherine, a qualified teacher with a PGCE, a BA in Photography, QTS (awarded in 2011), and the NASENCO award. The business was established in 2020 to deliver individualised and group tuition in English, Maths, and 11+ preparation for students in KS1–KS4, as well as SEN support across all age groups.

Fees and Payment

Fees are agreed in advance and charged per block of sessions. Pricing information is available at www.tutoriantuition.com.
All sessions must be paid for in advance. Tuition will not commence unless full payment has been received.
Payments must be made via BACS with the reference format: TUTORIAN + Student Initials (e.g. TUTORIANDS for David Smith).
Payment is non-refundable except where specified in these Terms or at the Tutor’s sole discretion.

Client Responsibilities

The Client agrees to:

Provide a quiet, interruption-free space with access to appropriate technology (stable internet connection, webcam, microphone, and printer if needed).
Ensure the student has necessary equipment: pen/pencil, paper, and relevant materials.
Supervise children under 18 during all online sessions.
Ensure punctuality for all sessions. Late attendance will not extend session time.

The Tutor will provide a folder, squared maths books, and lined English workbooks where necessary. Additional digital materials may also be sent via email.

Cancellations and Rescheduling

A minimum of 24 hours’ notice is required for cancellations. Less than 24 hours' notice will result in the full session fee being charged.
For holidays, at least 1 week’s notice is required to reschedule sessions.
If the Tutor cancels a session, notice will be given, and the session will be rescheduled at the earliest convenience.
In case of a genuine emergency, both parties will make reasonable efforts to reschedule. This is subject to the Tutor’s availability.

Technical Interruptions

If a tutorial is interrupted due to technical issues at the Tutor’s end, additional time will be added to the next session or rescheduled.
If a tutorial is interrupted due to issues at the Client’s end, the session will be charged in full with no additional time added.

Termination of Services

Either party may end the tutoring arrangement by giving at least two weeks’ written notice.
If the Client discontinues tuition without notice, no refund will be given for unused sessions.

Group Tuition Policy

No refunds will be provided for missed group sessions.
In case of absence, slides and homework (if any) will be provided via email.

Additional 11+ Tuition Policy

The Tutor may request the Client to purchase external resources (e.g. workbooks, practice tests).
Tuition may not proceed if required resources are not obtained.
The Tutor does not guarantee admission outcomes or exam results.

Safeguarding and Child Protection

All Tutors hold a current enhanced DBS check certificate, and a copy is available on request.
All tutoring will be delivered in accordance with UK child protection laws and the Safeguarding Vulnerable Groups Act 2006.
Sessions must not be recorded or photographed by the Client or pupil.
The Tutor may record sessions or take photos only with written consent from the Client and solely for educational, safeguarding, or quality assurance purposes.
The Tutor will never contact a pupil outside of lessons, and pupils must not contact the Tutor independently.
Parental supervision is required for all online sessions involving minors.
Any safeguarding concerns will be reported to the appropriate authorities. Katherine is the Designated Safeguarding Lead (DSL).

Data Protection (GDPR Compliance)

Personal data will be collected, stored, and processed in accordance with the UK GDPR and Data Protection Act 2018.
Information will only be used for administrative and educational purposes.
Client and student information will never be shared with third parties without consent unless required by law.

Intellectual Property

All resources, materials, and recordings created by the Tutor remain the intellectual property of Tutorian Tuition.
These materials are for personal use only and must not be shared, published, or resold without written permission.

Disclaimer & Limitation of Liability

Tutorian Tuition aims to support students' progress but makes no guarantees regarding specific academic outcomes or exam results.
We are not responsible for delays or failures caused by external factors (e.g., power outages, illness, internet disruption).
We accept no liability for indirect, incidental, consequential, or punitive damages.
Nothing in these Terms limits our liability for death or personal injury caused by negligence or fraud.

Dispute Resolution

In the event of a dispute, both parties agree to attempt to resolve the issue amicably.
If resolution is not possible, the matter will be referred to the courts of England and Wales, which will have exclusive jurisdiction.

Acceptance of Terms

By purchasing and attending tutoring sessions with Tutorian Tuition, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.
