SUBCONTRACTOR TUTOR
AGREEMENT
1. Status of the Tutor
1.1 The Tutor is engaged as a self-employed independent contractor and not as an employee, agent, or partner of the Company.
1.2 Nothing in this Agreement shall render the Tutor an employee of the Company, and the Tutor shall not hold themselves out as such.
1.3 The Tutor is responsible for their own tax, National Insurance, and any other statutory obligations.
2. Services to Be Provided
2.1 The Tutor shall provide online tutoring services in the subject(s) of English/Maths – KS1-KS4 to clients referred by the Company.
2.2 Sessions will be delivered using agreed platforms (Zoom).
2.3 The Tutor is responsible for adapting lesson planning, delivery, and maintaining a professional teaching standard.
3. Hours and Method of Work
3.1 The Tutor may set their own availability and is under no obligation to accept any particular assignment.
3.2 The Company does not guarantee any minimum number of students or tutoring hours.
3.3 The Tutor is responsible for ensuring a suitable working environment and equipment to deliver online lessons.
4. Fees and Payment
4.1 The Tutor will be paid £25 per 30 minutes and £40 per hour for tutoring services delivered.
4.2 The Tutor shall submit a monthly invoice itemising hours worked and students tutored.
4.3 Payment will be made via bank transfer within 14 days of invoice receipt.
5. Client Relationship
5.1 Clients remain clients of the Company at all times.
5.2 The Tutor shall not offer services directly to clients introduced by the Company for a period of 12 months after the last lesson without prior written consent.
6. Safeguarding and Compliance
6.1 The Tutor must:

Hold a current Enhanced DBS check for the child workforce

Show proof before working with students

Consent to regular rechecks or use of the Update Service

Undergo safeguarding training as required.
6.2 The Tutor agrees to comply with the Company’s safeguarding and privacy policies
7. Confidentiality and Data Protection
7.1 The Tutor agrees to treat all client information as confidential.
7.2 The Tutor shall comply with GDPR requirements and only use data for the purposes of delivering tutoring services.
8. Termination
8.1 This Agreement may be terminated by either party with 14 days' written notice.
8.2 The Company may terminate immediately for a serious breach (e.g., safeguarding failure, misconduct, non-performance).
9. Governing Law
This Agreement shall be governed by the laws of England and Wales.
